Today—both sides in the Brian Berger appeal must file arguments as to why Berger should or should not have been removed from office.
The New Hanover County Board of Commissioners voted last May to fire Berger.
Berger’s lawyers claim the move violated the state constitution.
The judge overseeing the case set today as a deadline for written arguments—and then the two sides will have until next Monday to file rebuttals.
Lawyers representing New Hanover County have filed a motion, asking the judge to rule that Berger can not collect new evidence in the case, and that he pay all of the county's legal fees.
So far, the judge has not ruled on that motion.
