The judge presiding over the Brian Berger appeal has set deadlines to hear from both sides in the case.
Berger is the former New Hanover County commissioner appealing his removal from office.
His attorneys say the Board of Commissioners did not act properly when they voted to oust Berger.
Judge James Gale wants both side to file briefs by August 19th--focusing on whether to board acted impartially and whether there was a factual basis for Berger's removal.
Once those briefs are filed, each side will have until August 29th to respond to opposing arguments.
The Board voted Berger out in May because of what commissioners cited as safety concerns for county staff.
