The state's only African American supreme court justice- is stepping down.
Patricia Timmons- Goodson was appointed to the state supreme court in 2006- and re-elected later that year.
Her term was supposed to last for 2 more years.
The departure means Governor Bev Perdue will get to name the replacement.
